Recent RMHA Member Sanctions
Tommy Smyth
A disciplinary hearing regarding a Board complaint filed against Tommy Smyth was held by the RMHA Hearing Panel on May 19, 2007. The nature of the complaint included the following charges:
1. acts causing the violation of RMHA Bylaws §1.2, RMHA Rules Section 8(4), and RMHA Rules Section 11(5);
2. acts causing the violation of RMHA Bylaws §1.2 and RMHA Rules Section 8(4);
3. acts causing the violation of RMHA Bylaws §1.2 and RMHA Rules Section 8(4);
4. acts causing the violation of RMHA Bylaws §1.2 and RMHA Rules Section 8(4);
5. acts causing the violation of RMHA Bylaws §1.2, RMHA Rules Section 8(4), and RMHA Rules of Registry §4.0;
6. acts causing the violation of RMHA Bylaws §1.2, RMHA Bylaws §7.3.4, RMHA Rules Section 8(4), and RMHA Rules of Registry §1.0; and
7. acts causing the violation of RMHA Bylaws §1.2 and RMHA Rules Section 8(4).
As to charge numbers 1, 4, 5, 6, and 7, Mr. Smyth was found to be violation, with both Ms. Elsie Hatcher and Mr. Tom Thurman voting that Mr. Smyth was in violation.
As to charge numbers 2 and 3, Mr. Smyth was found not to be in violation, with both Ms. Elsie Hatcher and Mr. Tom Thurman voting that Mr. Smyth was not in violation.
As a result of the Hearing Panel decision, the penalty imposed is that Mr. Smyth’s Membership in the RMHA is terminated for life, effective immediately, including, but not limited to, the prohibition of the following:
Registration of horses with the RMHA either as an individual owner, a co-owner, or as a member of an entity requesting registration;
Certification of horses with the RMHA either as an individual owner, a co-owner, or as a member of an entity requesting certification;
Acting as a buyer and/or seller (or agent of a buyer and/or seller) of Rocky Mountain horse
Advertising privileges in any RMHA publication or other medium;
Advertising in any medium wherein the words “Rocky Mountain Horse Association,” “RMHA,” or any other language suggesting an association with the Rocky Mountain Horse Association or that the horses being advertised are registered and/or certified as a Rocky Mountain horses;
Participation, of any kind, in any sanctioned show or other RMHA event;
Participation, of any kind, in any show wherein entrants must be registered and/or certified as Rocky Mountain horses;
Participation, of any kind, in any RMHA board and/or committee meetings or elections;
Petitioning the RMHA for re-instatement of membership.
Andrea Schaffer
A disciplinary hearing regarding a Board complaint filed against Andrea Shaffer was held by the RMHA Hearing Panel on May 19, 2007. The nature of the complaint included the following charges:
1. acts causing the violation of RMHA Bylaws §1.2, RMHA Rules Section 8(4), and RMHA Rules Section 11(5);
2. acts causing the violation of RMHA Bylaws §1.2 and RMHA Rules Section 8(4);
3. acts causing the violation of RMHA Bylaws §1.2 and RMHA Rules Section 8(4);
4. acts causing the violation of RMHA Bylaws §1.2 and RMHA Rules Section 8(4);
5. acts causing the violation of RMHA Bylaws §1.2, RMHA Rules Section 8(4), and RMHA Rules of Registry §4.0;
6. acts causing the violation of RMHA Bylaws §1.2, RMHA Bylaws §7.3.4, RMHA Rules Section 8(4), and RMHA Rules of Registry §1.0; and
7. acts causing the violation of RMHA Bylaws §1.2 and RMHA Rules Section 8(4).
As to charge numbers 1, 2, 6 and 7, Ms. Shaffer was found to be violation, with both Ms. Elsie Hatcher and Mr. Tom Thurman voting that Ms. Shaffer was in violation.
As to charge numbers 4 and 5, Ms. Shaffer was found not to be in violation, with both Ms. Elsie Hatcher and Mr. Tom Thurman voting that Ms. Shaffer was not in violation.
As to charge number 3, Ms. Shaffer was found not to be in violation, with Ms. Elsie Hatcher voting that Ms. Shaffer was in violation, and Mr. Tom Thurman voting that Ms. Shaffer was not in violation. Mr. Gary Neidert, as chair, voted to break the tie between Ms. Hatcher and Mr. Thurman that Ms. Shaffer was not in violation of charge number 3.
As a result of the Hearing Panel decision, the penalty imposed is that Ms. Shaffer’s Membership in the RMHA is hereby terminated for a period of at least ten (10) years, effective immediately, at which time she may petition the RMHA for reinstatement, including, but not limited to, the prohibition of the following:
Registration of horses with the RMHA either as an individual owner, a co-owner, or as a member of an entity requesting registration;
Certification of horses with the RMHA either as an individual owner, a co-owner, or as a member of an entity requesting certification;
Acting as a buyer and/or seller (or agent of a buyer and/or seller) of Rocky Mountain horse
Advertising privileges in any RMHA publication or other medium;
Advertising in any medium wherein the words “Rocky Mountain Horse Association,” “RMHA,” or any other language suggesting an association with the Rocky Mountain Horse Association or that the horses being advertised are registered and/or certified as a Rocky Mountain horses;
Participation, of any kind, in any sanctioned show or other RMHA event;
Participation, of any kind, in any show wherein entrants must be registered and/or certified as Rocky Mountain horses;
Participation, of any kind, in any RMHA board and/or committee meetings or elections
